CADILLAC OF TEST DRIVES VIDEO CONTEST OFFICIAL RULES
CONTEST DESCRIPTION. The Cadillac of Test Drives Contest ("Contest") is a skill-based contest to determine the contestant (“Contestant”) who submits the highest rated blog according to the Judging Standards set forth in rule 6. Contestants can register to participate at www.CadillacofTestDrives.com (the “Contest Site”). Sponsor will select which Contestants will participate in the Contest, in its sole discretion. Those who are selected will go to www.CadillaofTestDrives.com where they will be given a time and date to appear at a participating Cadillac dealership near their respective residences, along with up to three friends who have reached the age of majority. The Contestant will be loaned a Cadillac SRX to test drive. Contestants will all be provided with an American Express gift card with the value of $25 per person, up to $100. The Contestant and friends will all be required to complete a General Motors Personal Services Agreement and the Image Use Release.
Contestant must do all the driving of the SRX. After the test drive is completed, the Contestant can post a blog and photos about their experience test driving the SRX. Public voting on the blog will determine the grand prize winner.
ELIGIBILITY-NO PURCHASE NECESSARY. This Contest is open only to legal residents of fifty United Sates and D.C. who have a valid driver’s license and are 25 years or older at the time of the test drive. Test drives Employees of Sponsor and its parents, affiliates and subsidiaries, participating advertising and promotion agencies and prize suppliers, and their immediate families or persons living in the same household of such individuals, are ineligible. CONTEST IS VOID WHERE PROHIBITED BY LAW.
HOW TO REGISTER: Any individual wishing to participate in the Contest, must first register at www.CadillacofTestDrives.com for the overnight test drive, thereby becoming an eligible Contestant. Registration is free and available at the Contest Site. The number of test drives are limited to two to three test drives per week per participating dealer. Contestants must register for the test drive. Test drives must be taken within 100 miles of the dealership. Any contestant that exceeds 100 miles may be disqualified from the contest.
SUBMISSION OF BLOG/PHOTOS: The contestants will, after completing the test drive be encouraged to log back onto www.CadillacofTestDrives where a blog will have been set up for them. The contestant can then write about and post photos (not required) about their experience test driving the SRX staying within the requirements in rule 5. Each contestant’s blog will be online and active for fourteen day (from the activation date). Each blog will have a countdown and a mechanism for voting for the contestant’s blog. After fourteen days, votes will not be accepted. The Contestant’s blog that receives the most votes will be the winner of the $250 donation to a charity of their choice. Each participating dealer will have a winner. Test drives (and subsequent blogs) will be active beginning at March 1st at 12:00AM EST and will end no later than April 30th at 11:59PM EST (“Contest Period”). The specifications, including format and length, for each blog Submission will be determined by Sponsor in its sole discretion and posted at the Contest Site. Follow Submission instructions at the Contest Site. Any Submission that fails to meet the Sponsor’s specifications may be disqualified.
Limit one entry per person or email address. Subsequent entries will be disqualified.
SUBMISSION REQUIREMENTS:
The Submission must be the Contestant’s original work, must not have been previously published or exploited in any manner or medium, must not have won previous awards, and must not infringe the copyright, trademark, privacy, publicity, or other intellectual rights of any person or entity.
Submissions cannot be entered if Contestant or parties who work with Contestant in conjunction with his/her Submission: 1) are represented under contract (e.g., by a talent agent or manager); 2) have an acting or modeling contract that would make their appearance in the Submissions a violation of any third-party rights; or 3) are under any other contractual relationship, including but not limited to guild and/or union memberships, that may prohibit them from participating fully in this Contest, or from allowing Sponsor to use royalty-free, the Submissions worldwide in all media in perpetuity;
Submissions cannot and will not be sexually explicit or suggestive, contain full or partial nudity or any pornographic material or contain any content that is violent or derogatory of any ethnic, racial, gender, religious, professional or age group;
Submissions cannot and will not contain any content that is otherwise lewd, offensive, inappropriate, or obscene;
Submissions cannot and will not contain any content that is derogatory, profane, defamatory, libelous, slanderous or disparaging;
Submissions cannot and will not contain any content that is false, deceptive, misleading or otherwise not in compliance with applicable laws.
Submissions cannot and will not contain or promote the products or services of any company or entity, with the exception of Sponsor, or contain any trademarks, logos or trade dress or promote any brand or product or any kind;
Submissions cannot be inconsistent with the good will and positive images which Sponsor desire to promote;
Submissions must be based on the theme designated under these Official Rules;
Submissions must not contain any content that would be inappropriate for broadcasting on network television, as determined by Sponsor in its sole discretion;
Submissions cannot and will not promote any activity that is unsafe, hazardous or dangerous;
Submissions cannot and will not promote any activity that is prohibited by law;
Submissions must meet all specifications set forth by the Sponsor in these Official Rules and on the Contest Site, including length and format; and
Contestants agree to indemnify and hold harmless Sponsor against any and all claims of infringement from any third party for any use by Sponsor of any Submissions submitted by Contestant. If the Submission contains any material or elements that are not owned by the Contestant and/or which are subject to the rights of third parties, the Contestant is responsible for obtaining, prior to uploading the Submission, any and all releases and consents necessary to permit the exhibition and use of the Submission in the manner set forth in these Official Rules. Contestants shall be responsible for obtaining, and all Contestants will be required to submit, written releases from any individual appearing in any Submissions which grant to Contestant the right to use his or her name, likeness and performance in connection with Contestant’s submission in this Contest, and all related uses by Sponsor, as determined within their sole and absolute discretion. In the event that any person appearing in any Submissions is a minor, the release must be obtained from such person's parent or legal guardian. Sponsor reserves the right to request proof of such release in a form acceptable to Sponsor from any Contestant at any time during or after the Contest, and to disqualify any Contestant at any time who is unable to provide such proof to the satisfaction of Sponsor.
All Submissions become the property of Sponsor. They will not be returned or acknowledged. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human, or electronic. Submissions that do not comply with these Official Rules in all respects are ineligible and void.
The entries will be judged in accordance with the Judging Criteria, as defined below in Rule 6.
JUDGING:

- For each contestant, beginning within a day of returning the vehicle and for fourteen days after members of the public (the “Voters”) can go to the Contestant’s blog on the Contest Site and vote for their favorite Submission. Voters must provide their name and email address. Voters are allowed only one vote per valid email address. At the conclusion of the Online Voting Period, the Contestant with the most votes (for each participating dealer) will be the winner, subject to verification of eligibility and compliance with the Official Rules and Terms of Service for the Contest. In the event of a tie, the winner will be chosen randomly. Decisions of judges are final and binding. The Voting period ends April 30, 2010 at 11:59 EST. The winner will be announced on or before May 15th and displayed on the Contest Site.
SPONSOR'S RIGHT TO DISQUALIFY: At any time during the Contest, Sponsor reserves the right in its sole and unfettered discretion to disqualify and remove any Submission that it believes potentially or actually infringes upon the copyrights, or other rights of any third party, or otherwise does not comply with these Official Rules.
WINNER NOTIFICATION: The potential winner will be notified by mail, email or telephone and must respond within seven (7) days of prize notification in order to redeem prize. All prize claims are subject to verification and compliance with the official rules. If Sponsor is unable to contact potential winner within seven (7) days of first attempted notification the prize may be awarded to an alternate winner chosen at random from among all remaining Contestants. Sponsor reserves the right to substitute prize for an item of equal or greater value. The prize is awarded without warranty of any kind from Sponsor, express or implied, without limitation.
PRIZES: Each participating dealership will have a winner and will make a donation of $250 in the winner’s’ names to a charity of their choice.
CONDITIONS OF PARTICIPATION: By participating, Contestants agree to release, discharge, and hold harmless Sponsor and its parents, affiliates, subsidiaries, agents and their employees, officers, directors, and representatives from any liability, claims, losses, and damages arising out of their participation in the Contest or any Contest-related activities and the acceptance, use, misuse, or possession of any prize received in this Contest. Contestants also agree (a) to be bound by these Official Rules; and (b) that the decisions of Sponsor are final on all matters relating to the Contest. Winner may be required to sign an affidavit eligibility/liability/publicity release and transfer of copyright before within seven (7) days of attempted notification. Failure to comply with these deadlines may result in forfeiture of the prize. All federal, state and local taxes, fees and surcharges on prizes are the sole responsibility of the winners. If the Winner declines the prize or is unavailable for prize fulfillment, an alternate winner will be selected at random from all remaining Contestants. Acceptance of the prize constitutes permission for Sponsor and its agencies to use winner’s name and/or likeness for advertising and promotional purposes without additional compensation unless prohibited by law.
INTERNET: Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Sponsor reserves the right to select winners from eligible entries received as of the termination date. Sponsors further reserves the right to disqualify any individual who tampers with the entry process. Caution: Any attempt by a Contestant to deliberately damage any Web site or undermine the legitimate operation of the game is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such contestant to the fullest extent of the law.
GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants or Sponsor in connection with the Contest shall be governed by and construed in accordance with the internal laws of the state of Florida, without giving effect to any choice of law of conflict of law rules or provisions that would cause the application of any other state laws. Claims may not be resolved through any form of class action. Venue for all suits will be in federal or state courts located in Delaware.
